These Terms of Service (“Terms”) govern your access to and use of the free CRM audit tool and related services (“Service”) provided by Forward Flow (“Forward Flow,” “we,” “us,” or “our”) at forward-flow.com. By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
Forward Flow provides a free, web-based CRM audit tool that allows real estate professionals to connect their CRM accounts (currently Follow Up Boss and Lofty) via read-only API access and receive an automated report analyzing CRM health metrics. These metrics may include, but are not limited to:
The Service is provided free of charge. There is no subscription fee or payment required to generate a CRM audit report.
By submitting your information through the Service, you represent and warrant that:
You agree to provide accurate contact information (name, email, phone number) when using the Service. Providing false or misleading information is a violation of these Terms and may result in denial of access to the Service.
You are solely responsible for ensuring that any API key you submit belongs to a CRM account you own or have explicit authorization to connect. You must not:
By submitting your phone number and/or email address, you expressly consent to be contacted by Forward Flow via email, phone call, and/or SMS/text message regarding your audit results and Forward Flow services. See Section 5 for full SMS terms.
You agree to use the Service only for lawful purposes and in compliance with all applicable federal, state, and local laws and regulations. You may not use the Service for any fraudulent, abusive, or harmful purpose.
The Service uses your CRM API key exclusively to perform read-only data requests (e.g., fetching contacts, lead records, and activity history). Forward Flow does not and will not use your API key to:
Your API key is not stored by Forward Flow. It is used only during the active report generation session, transmitted over an encrypted connection, and discarded immediately after use. You retain full control over your API key and may revoke it from within your CRM at any time.
Your use of your CRM API in connection with the Service remains subject to your CRM provider's terms of service and API usage policies. Forward Flow is not affiliated with, endorsed by, or a partner of Follow Up Boss, Lofty, or any other CRM provider unless expressly stated.
Report generation depends on the availability and responsiveness of third-party CRM APIs. Forward Flow is not responsible for delays, errors, or failures caused by downtime or changes to CRM provider APIs.
TCPA Consent: By providing your mobile phone number, you provide prior express written consent to receive recurring automated promotional and informational text messages (e.g., SMS and MMS) from Forward Flow at the number provided. Consent is not a condition of any purchase. Message and data rates may apply.
You may opt out of text messages at any time by replying STOP. Following your opt-out request, you will receive one final confirmation message. No additional SMS messages will be sent to your number unless you re-opt in.
For help, reply HELP or contact us at the information provided in Section 13. Supported carriers include all major US carriers; however, carrier availability is not guaranteed.
Forward Flow does not guarantee the delivery of SMS messages. Delays or failures in message delivery may occur due to factors outside our control, including carrier networks, device settings, and geographic coverage areas.
Important: All calculations, scores, grades, and revenue estimates generated by the Service are estimates only. They are based on algorithmic analysis of your CRM data and industry benchmarks. They do not constitute financial, legal, or professional real estate advice.
All content, software, algorithms, design elements, trademarks, and materials associated with the Service — including but not limited to the CRM audit methodology, grading system, report format, and website design — are the exclusive property of Forward Flow and are protected by applicable intellectual property laws. You may not copy, reproduce, modify, distribute, or create derivative works from any portion of the Service without our prior written consent.
You retain ownership of your CRM data. By using the Service, you grant Forward Flow a limited, non-exclusive license to access and process your CRM data solely for the purpose of generating your audit report and as described in our Privacy Policy.
Any feedback, suggestions, or ideas you submit regarding the Service may be used by Forward Flow without restriction or compensation to you.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, FORWARD FLOW AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR:
IN NO EVENT SHALL FORWARD FLOW'S TOTAL CUMULATIVE LIABILITY TO YOU EXCEED ONE HUNDRED DOLLARS ($100.00), EVEN IF FORWARD FLOW HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. BECAUSE SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU IN FULL.
THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE. FORWARD FLOW DOES NOT WARRANT THAT:
You agree to indemnify, defend, and hold harmless Forward Flow and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses — including reasonable attorneys' fees — arising out of or in any way connected with:
We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, for any reason, including if we reasonably believe you have violated these Terms. You may stop using the Service at any time.
Sections 6 (Disclaimers), 7 (Intellectual Property), 8 (Limitation of Liability), 9 (Disclaimer of Warranties), 10 (Indemnification), and 12 (Governing Law) shall survive any termination of these Terms.
These Terms shall be governed by and construed in accordance with the laws of the United States and the state in which Forward Flow is principally located, without regard to conflict of law principles.
Any dispute arising out of or relating to these Terms or the Service shall first be subject to good-faith informal negotiation. If the dispute cannot be resolved informally within 30 days, the parties agree to submit to binding arbitration in accordance with the rules of a mutually agreed-upon arbitration body. Class action lawsuits and class-wide arbitration are waived to the fullest extent permitted by law.
Nothing in this section shall prevent either party from seeking injunctive or other equitable relief from a court of competent jurisdiction where necessary to protect intellectual property rights or confidential information.
We reserve the right to update or modify these Terms at any time. When we make material changes, we will update the “Effective Date” at the top of this page. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Forward Flow with respect to the Service and supersede all prior agreements, understandings, and representations.
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
Failure by Forward Flow to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision in the future.
You may not assign or transfer your rights under these Terms without our prior written consent. Forward Flow may assign its rights and obligations under these Terms without restriction.
